Microsoft should fight back....here's a little tidbit I found while looking into the MSFT case which seems quite relevant.

"Experts on class action law say more and more companies are choosing to stand and fight. DaimlerChrysler, the German-American auto-maker, is even taking the offensive: it recently brought a suit against a Philadelphia law firm to recover costs in what it claims was a frivolous case involving seat design.

DaimlerChrysler says it is determined to fight the "legalised blackmail" involved in such lawsuits. Until Congress steps in to tackle class-action abuse, companies may have to rely on the courts to fight back."
