I don't think the above statement is quite true.

According to IBM patent search you once
recommended some time ago, There are four
patents related to PEM fuel cells I managed to
find on the site, three of them joinly owned by
both Ballard and Daimler-Benz.

Also, fuel cell was first invented by
William Robert Grove in 1839.
Ballard only claimed that they are
the world leader in the development
of proton exchange membrane fuel cells.
To my limited understanding of the
technology. Ballard made significant
improvement in the technology.
Ballard's leadership would be their
improvement of the membrane which
gives their fuel cells a very high
power density 28 kw/ft^3.
