Two recent articles written by George Mannes, a staff reporter for
THESTREET.com, have caused the company to file suit today against both the
reporter and his employer. The defendants have also been sued by two
individuals also allegedly defamed in the articles. The suit was filed at
4:15 p.m. in the Volusia County 7th District Circuit Court of Florida.
Michael Cimino, ZZAP's President, said, "When our request for a retraction
was curtly rejected by THESTREET.com's editors, this was the only avenue for
redress open to us in order to protect our shareholders from further potential
damage."
The suit specifically charges the defendants with Commercial Defamation,
Trade Libel and Tortuous Interference against the company.
Mr. Richdale and Mr. Cimino, both of whom were allegedly defamed by
Mannes, have also joined in the suit filed against both defendants.

ABC. Com, has recently written two questionably negative articles on the
company.

we just decided to ignore it as an unflattering report from either a novice or
uninformed reporter. After the second article, we decided we could no longer
ignore his repeated use of unsubstantiated, unfounded, one-sided rumors as

The company has recently acquired a substantial stake in Summus
