I think we are talking semantics here. You can hit the bid with a short sale pre market and happens all the time to take down the price to give the appreance that the stocks going to really tank, or short selling in other markets without the uptick rule. Once momentum takes over, its purpose is served. But during market hours such trades are considered illegal.
