I have to agree that this is something that SI and only SI can manage. I think first you need to build a more clear and enforceable set of rules than the current "terms of use". Once articulated and agreed to the users should be bound by these rules - period. Asking to community to accept and reject re-instatements is a popularity contest - nothing more. These days a vocal bear wouldn't have a chance :-)
