Maurice,

Should the Q jump into the GSM arena do you think they will have to license that technology from someone just as they have licensed CDMA? My guess is they will.
Jacobs even mentioned a cross-licensing agreement. Have you been following the status of the ERICY versus Interdigital case? In case you haven't here are some details on the proceedings from the court docket. As you will see it's active right now and approaching the pre-Markman hearing. Wasn't it at the Markman hearing that Q and Ericy settled?

The Q was pretty foxy in that issue and sent the patent in question back to the patent office for reexamination. That made the case for the Q. It was now impossible for ERICY to produce an expert witness to try and invalidate a patent that has been issued and reexamined by the patent department. The reexamination time frame alone was almost two years. By the way IDC chose the same path as the Q and the patents ERICY is seeking to invalidate in Texas have also been reexamined and approved.

Last March Nokia struck a deal with IDC and gave them 30 million up-front and another 40 million is forth coming over the terms of the agreement. IDC is providing help to Nokia in Nokia?s 3-G efforts. Many thought it was odd why Nokia went to Interdigital for assistance with W-CDMA versus the Q. It's a little to early judge Nokia's wisdom on that decision because no one knows to date what progress has been made in this joint effort. I read somewhere Nokia likes to keep the bread in the oven until it's done so maybe that's the case? Seems no one including Tero has a clue what's going on between IDC and Nokia. What ever is going on according to the news release IDC will retain all rights to the IPR.

Speaking of IPR,IDC as the Q and many others have submitted many offerings to the ITU. These are the comments of MR Goldberg on those submissions.

biz.yahoo.com

``We believe that we have technology, patents and patents pending that will be essential to the implementation of all modes of the standard. We are extremely well positioned as a developer of creative and valuable technology content for 3G wireless products.'

I thought it was odd he mentioned IPR in all modes. Does IDC have IPR in the Q's proposal?

Have you seen the patents that have been issued to IDC lately? Some think they fit in an area where the Q dominates? I don't understand patents at all so maybe you or Clark might afford comment. Some even think Q,s present form of forward and reverse pilot coding or UN-coding is IDC's IPR which was not included in their settlement. Here are the new patents.

Patent # 5,991,329 Issued 11/23/1999
Automatic power control system for a code division multiple access (CDMA) communications system

Patent # 5,991,332 Issued 11/23/1999
Adaptive matched filter and vector correlator for a code division multiple access (CDMA) modem

Patent # 5,995,538 Issued *Nov 30, 1999
Spread spectrum multipath processor system and method

If the results of the IDC dispute with ERICY is favorable like the Q's, what type of financial reward do you think IDC may have coming considering there's around 400 million current users of GSM/TDMA and PHS? Do you think ERICY can prove the patents are not valid? Seems the market lately also believes that some or all of IDC's vaporware is for real?

Well they say history repeats itself so it will be interesting to see if the Q will get a GSM license from IDC? It will be also interesting to see if the Q is interested in Japan and dual mode?
