Brian: I don't think Posner will see this kindly although he is of course just and advisor of course and unless this was his advice to DOJ. It would seem to me that this is just another poorly veiled threat to try and get MSFT to settle before the embarrassment of an Appeals reversal. If so it was clumsily done and it would indicate 2 things 1. The states are in disarray and don't even know what they want versus what they partner in crime DOJ would want 2. They have the cart before the horse. Now if Posner did not recommend this than they will be seen by the mediator as trying to mess with the process of mediation. If I were him and this wasn't my idea I would say to myself "I thought it was my job to bring this thing to an out of court concord if possible". Arrogance shoe is definitely on the DOJ foot on this one. JFD
