My synopsis:

VISX holds a number of different patents that protect their laser franchise. The ruling involved 2 of these patents and the dispute will not be settled for at least another year and a half. This suit is but one of the suits against Nidek and is VISX's weakest. The unfavorable ruling should accelerate the process of forming license agreements with B&L and LaserSight.

BEAM's dependence on VISX's performance here is based entirely on the two companies' ability to continue to charge the per procedure fee. That fee could be threatened if practitioners entering the field of laser eye surgery suddenly started going to Nidek for their new lasers. The ruling by no means opens up the US market for Nidek. VISX will continue to seek protection for the patents affected by this decision and both VISX and Summit will continue to aggressively protect their other intellectual properties at the core of their franchises.
