So, here we have a situation where we the defendants were totally and unequivocally released from all charges against us. This is not a judge or jury saying this, this is the plaintiff, Business Wire, themselves! How much better could one expect?! Now we have Safeco Insurance agreeing to pay 100% of the settlement. As a defendant, isn't another goal to not have to pay a single penny in settlement money?
As I said before, this is the best result you could reasonably expect. My point is that BW exacted a toll on you, Bill and Janice in terms of time, effort, anxiety, etc., that BW did not suffer themselves. $100K is not a big deal to BW, and I doubt Lokey lost any sleep over this, but I bet you did. If, however, BW gets sued based on Lokey's ridiculous comments about their factual investigation of PRs, it may be a sweeter victory than you could have obtained for yourselves. It will just be a delayed gratification.
My point seems to be getting lost, so let me try to be perfectly clear: This is a good result. I am happy for you. I'm disgusted with BW's actions both during the lawsuit and in the recent PRs. BW used its superior financial position to intimidate individuals over an "insult." This lawsuit should never have happened. If you want to call it a victory, I suppose you are entitled. After all, it's your lawsuit. We are just spectators. |
