Ok, let's look at this reasonably...

Scenario 1: Tice's assertion that Tyco has "accounting irregularities" is proven to be true by the SEC inquiry.

If this is a true scenario, then Tyco will have to answer to many Tyco shareholders of record in a monumental class action lawsuit in the U.S. justice system.

Scenario 2: Tyco's assertion that they do not have any "accounting irregularities" is proven to be true by the SEC.

If this is a true scenario then Tice, et al, will have to answer to many Tyco shareholders of record in a monumental class action lawsuit in the U.S. justice system.

The questions in my mind right now are as follows:

1. How long will this informal inquiry by the SEC last? It would seem that a swift resolution is of paramount concern to all parties.

2. Who knew of this informal inquiry BEFORE it was announced this morning? It seems pretty obvious to me that people MUST have known about the forthcoming news. The downward pressure on Tyco after it's recent high of $45/share in November has been tremendous.

3. Will downgrades from key supporters be forthcoming in light of today's informal inquiry announcement?

4. If Tice's assertions against Tyco are proven to be false and baseless, can he (Tice) be held accountable by shareholders in court? Likewise, if Tyco is proven to have misled investors, can they (Tyco) be held accountable by shareholders in court? Are there any lawyers here?

5. Many, many analysts have reviewed Tyco's accounting practices since Tice made his assertions. As a result, many analysts and many firms have publicly stated in press releases they could find no irregularities in Tyco's accounting practices. Some of the most respected names in the industry have Tyco listed as either a buy or strong buy in their respective recommended lists. How is one man (Tice) affecting this stock so much? Are we hearing the full Tyco story?
