Actually, the referral is made to Child Protective Services ("CPS"), which investigates the allegations, and if they determine that the allegations are, or may be, founded, have a variety of options, which include petitioning the Court to enter orders for the protection of the child. Worst case, taking the child away and eventually terminating parental rights. But that's rare. Most likely a referral to parenting classes.

CPS can take a child away from the parents and put the child into foster care without a court order, but must seek court review immediately. If the child is taken away on Friday afternoon, that won't be until Monday morning. I've seen it done.
