Buying the breakout seems the safer course. There's no guarantee it will happen, so buying the stock at current levels means incurring a lot of risk for a relatively small incremental reward. Supposing for a moment that I agree with your target of $160, I can get $55 of that buying the stock at $105, versus $65 buying it now.

I don't know where you lads are getting your figures, 100 3/4, 97, and so forth. Can you really look for a breakout signaled solely by price movement? What if the stock goes to 101 on a tepid rally then turns back? I'd rather buy a breakout driven by good news and specifically with respect to the anti-trust case. I'm not confident the stock will move on good earnings next month. The mere fact that you're talking about the earnings means the market is already anticipating that bit of good news and is factoring it into the price.
