Now let's change the names. Att is delivering data through the ATHM face in a telephony area which is dominated by SBC. Att would like to compete in that local area for voice and SBC would like to compete in data and retain what could be grabbed by Att through cable if SBC has no presence in that "space". SBC goes to ATHM and says, "we'd like you to take our 'bone feed and tap in at your RDC or take our physical 'bone to Att's head end in order to supply BB:telephony and Internet. Att can't object since Att wants SBC to open up the local market, but at the same time the RDC tap opens SBC's local market since Att would then be able to uplink into the local area's circuit switched telephony through the tap. Is this coherent and can SBC legally block the uplink through the tap?
