It appears that gives a real competitive advantage to a merchant that's not national.
I'm still confused on this nexus issue. If I recall, when I buy books from BnBn. I don't pay sales tax even though they have
a store close by.
The policing of this must be difficult.

Congress is already pushing to do something about this since the states are losing too much revenue. In the meantime, BNBN is not BKS and BNBN likely does not have a distribution center in CA or WA. Therefore, no nexus.

There was a case by the states agains Quill corporation about coolecting sales tax prior to them being bought by Stables I believe. The Supreme Court held that a nexus is required for a state to have the right to collect sales tax and so the lower ruling against Quill was overturned. The Consitution will prevent states from collecting sales taxes on firms without a nexus due to this ruling.

The present move to make a "Use Tax" like hotels typically have. The states are lobbying for this and will likely win.

In the meantime, there is a hugh advantage to buying from a firm without a nexus on large ticket items.
