I think what this all really comes down to is whether there is the ability to pass this cost onto the consumer. I think that the real issue is that the public is getting tired of paying for the health care costs of smokers. So the solution is to pass the cost onto them. The problem is that if there is simply an increase in cig. tax then there is the argument that the poor (who typically are the smokers) are being tax disproportionatly to the wealthy. So the settlement in effect will make the manufacturer the tax collector. If everyone has to raise their prices an equal amount, then it should not make people shift brands.
In my opinion, the only people who are going to raise a stink about this settlement are the ones who have been getting rich. The lawyers on both sides. What the companies save in lawyer fees will probably pay for a good part of the settlement.
These are my opinions only for what they are worth.
