Hi Jim,

Merely buying and selling short term does not qualify as P&D.

P&D is when you have a special relationship with the company management, and buy (or are given) shares, aggressively advertise a one-sided story regarding the company's prospects to a large audience, and then take profits. I seriously doubt you've done that.

There are variations of course. If you have a large enough following, you merely have to mention the ticker symbol. TokyoMex attained that status. But he also wove stories about stocks (DCGR comes to mind). And then -- surprise ! The next thing you know the float has increased by a few million shares !

I'd say the a good rule is: If a company contacts you to promote their stock, and you know they are looking for financing (via either dilution or shorting), and you buy, then advertise and sell, then you are pumping and dumping.

Or if you help someone do this and you pretty much know they are connected ......

Anyway, just my opinion,
Chris
