Howard, To whom did you speak at Quidel?? Re: your comment "does not look good for Quidel at this point", is that your assessment, Quidel's assessment or is it based on the complaint filed by BD only?? To the best of my knowledge, Quidel hasn't even filed a answer to the lawsuit yet (probably not due till May 7 or 8). I checked out the US patent office website and the "Rubenstein " patent mentioned in a prior post (#629) was granted to BD in 1-97, while Quidel has at least 16 prior patents granted, some of them (from their brief description on the website) appear to cover their one step Quickvue tests quite adequately (from a layman's perspective relying on someone else's synopsis of the patent!!!!!).
