Does that imply inside information and insider tradng via 3rd party(i.e. f and f)?

I sold all but 100 shares, made a little, and waiting on qtr report and resolution of IPIX patent infringement suit. This suit is public information, and obviously BAMB, doing due diligence, determined that it was immaterial before entering into a merger agreement. Or did they?
