I guess NXTL figures it can either pressure regulators and Congress by virtue of the hostile bid, or that the slippery slope of changing the terms of eligible bidders is already in place, for it to go ahead with the bid. An amazing, if not totally unexpected, development. WCOM (including Sprint, which was very vocal in its opposition to a possible NXTL acquisition of the spectrum this summer), and perhaps T, will still cry foul. And what of the spectrum the FCC owes QCOM for its arbitrary refusal to consider Q's application in 1995?
It will be interesting to see how GBLX and Malone respond.
