NEW YORK--IBM, the giant computer maker, has filed a lawsuit against rival EMC, maker of large data-storage systems, alleging it violated a patent agreement and committed fraud by secretly transferring disputed patents to a shell company, according to reports.

The suit, filed last week in U.S. District Court, involves a patent fight dating back to 1994 between IBM and Data General Corp., a computer server and storage device maker that EMC acquired in October. The IBM action claims that EMC breached a patent cross-licensing agreement with IBM which stated that IBM was entitled to license any EMC patents, including those obtained through acquisitions, the Wall Street Journal said, citing unnamed representatives of both companies.
