Hello Marcos, the owners of the surfaces rights do have rights. Their land is protected by law.

Land ownership especially in an urban area is usually filed at the registry as a public deed. It is not much different than other places. No one can force them to move. Owners bought this land from the government. It is theirs.

The mining law states that there must be an agreement with the owner of the surface rights before exploration or mining starts. This is easy in the exploration stage. Give the owner $5000 to let him drill in his backyard, but this doesn't mean the property is sold. It just gives MAN the right to explore. MAN will have to deal with each individual and company.

However there is another Peruvian law that government can step in if it is in the best interest's for the country. This obviously favors MAN but let's not forget that this is an agricultural area as well. Rich in Mangos etc. Owners of the land may resist the development of the mine. Dealing with Latinos isn't easy. The first one will be easy, the last will be difficult.
