Don't you have to charge tax if you do business "in the state" - therefore, if you have a B&M operation there where customers are entitled to return items, then its a taxable transaction. If the online presence is a separate legal entity then its no tax but then no returns. I have to say, even I think this is unfair... some sort of standard tax will have to be levied for all online purchases is my guess - or take them all away.
