I also hope that your reasoning below is correct since I am a declared non-resident since 1995 but trade through my discount broker in Canada. I am having this checked. As a non-resident I do not have to file an income tax return in Canada but I do in my country of residence (which fortunately has no idea of the capital gains concept). Even if you live outside of Canada you need to be declared a non-resident not to pay Canadian taxes. Until then, you have to file a return and include capital gains. And there is a strict set of rules (like no intent to come back for a few years) that the gov. applies to decide your status.
