We had a great discussion on the HYSQ Yahoo message board regarding the patents in mid December. You may want to go check that out. From what I've read AFFX was a late-comer into the gene business and filed a few thousand patents. The problem is that much of what they did wasn't new, and wasn't created by them. They tried to create a sort of patent monopoly on research that had been there for years, and other companies will ultimately be able to prove it. They also have a problem with patent technology (Oxford Gene) that they claim was transferred to them. The problem with that one is that the company that transferred rights may not have had the legal right to do so. Oxford Gene vs AFFX will be heard in a British court next month.
