Frank- I'm thinking Excite@Home(sym:ATHM) should now go crying to the FCC demanding, "Open Access," to AOL's newly purchased cable pipes. Wouldn't that be giving AOL a taste of their own medicine. And the timing couldn't be better for ATHM because they even said, a few weeks ago, they are going after more deals beyond T/TCI.

I find it amazing how easily the media can be manipulated to take a stand on certain issues. In this case so called, "Open Access." Now let's see what happens as AOL/TWX combo spends billions upgrading their plants to two-way HFC. Then ATHM can demand open access to their pipes. I bet AOL sings a different tune now.

Another thing I'm wondering. How the cable telephony deal, AT&T's Mike Armstrong was working on with TWX, will now evolve? This has to complicate things, but AT&T is the one with the capital that can make it work. I don't think TWX or AOL can raise as much or have the brand awareness(for phone service) T would bring to the table. I would think both need T.

Hopefully getting this deal out of the way brings the local cable telephony deal to the front burner. My guess is it will.

Overall I consider this merger (AOL-TWX) another strong indication of the viability of the cable plants(understatement). BTW there is yet another billion(!) dollar cable deal Microsft was/is working on that I have not had time to check out. I believe it's in Japan. -MikeM(From Florida)

PS I have equal positions in AOL and ATHM. So I'm really just glad to see the value of the cable plants being recognized by all the fighting.
