3Com Sued by Disney Alleging Contract Breach

WASHINGTON (Reuters) - 3Com Corp. (NasdaqNM:COMS - news), which makes the Palm line of hand-held computers, modems and other network equipment, said Monday it was being sued by Walt Disney Co. (NYSE:DIS - news) for $15 million for alleged breach of contract.

The lawsuit was filed on Nov. 4 by Disney Interactive Inc., which develops and distributes family entertainment and educational CD-ROMs and video games like ``Who Wants To Be a Millionaire,' based on the ABC game show.

The case, filed in Los Angeles County, alleges breach of a purported contract for the bundling of Disney Interactive video products with 3Com's modems.

The suit was disclosed in 3Com's latest quarterly report filed with the Securities and Exchange Commission.

The legal action is in the discovery stage and no trial date has been set yet, 3Com said, adding that Disney Interactive is seeking damages in excess of $15 million.

A 3Com spokesman said the company plans to vigorously defend itself. Disney spokeswoman Christine Castro said her company did not comment on litigation. Neither would provide more details of the case.

3Com shares were off 1/8 to 46 on Nasdaq while Disney was up 3-13/16 to 35 on the New York Stock Exchange in afternoon activity.
