Patent Covers the Production of AAV Without Need of 'Helper-Viruses'

ALAMEDA, Calif., Jan 5 /PRNewswire/ -- Avigen, Inc. (Nasdaq: AVGN - news) today announced the issuance of United States Patent No. 6,004,797 to Avigen entitled ``Adenovirus Helper-Free Recombinant AAV Virion Production' covering genetic constructs and methods for producing recombinant adeno-associated vector (AAV) without using adenovirus or other pathogenic helper viruses. The issued claims encompass any method of producing AAV utilizing the claimed genetic constructs, including transfection-based and packaging cell lines.

Unlike other viruses, AAV is incapable of replicating on its own. A cell which contains AAV must be co-infected with a second ``helper virus,' typically adenovirus or herpes virus, for AAV itself to replicate. This requirement also exists when AAV is manufactured for research or commercial purposes. Up until now, large scale manufacturing of AAV also required a so-called ``helper virus.' Because adenovirus and herpes viruses are known pathogens that are highly toxic to humans, Avigen scientists identified the small fraction of genetic elements within adenovirus that provide AAV helper functions and thereby allow AAV vectors to be made free of any contaminating helper viruses.
These genetic elements work better than live virus, while completely eliminating the risk of transmitting any pathogenic helper virus.
