How quickly things change! This ruling is now favorable to DISH because News Corp, which was the partner to MCI at the time of the auction, actually ended up with the MCI slot and that slot is one of the major assets they are exchanging for their stake in DISH/SKY. At the time they filed their opposition, DISH was a competitor; now, had the ruling gone in their favor, they would have lost the slot. BTW, for those that thought that it was taking a long time for DISH and News Corp. to make their required filings, I wouldn't be suprised if the delay was at least in part to see the outcome of this ruling, since the loss of this asset by News Corp would have dramatically shifted the valuation of their equity contribution to the new company.
