abbigail: This AM announcement via DOJ leak and what it means: 1. This is old news we have all known this was what the DOJ was seeking from the get go. 2. The surprise should be is that the ycouldn't get a consensus on this until now. 3. I am sure Posner has been asking them to come up with consensus remedy so that they have a starting position to negotiate from. 4. DOJ couldn't get a consensus without going to the most Draconian remedy. 5. They realized that selling MSFT's code wouldn't help the buyers and it is only an asset in the hands of MSFT. 6. Indicates that the states have no real idea of what they want and why on earth they are even along. 7. Now that the have presented this most Draconian of solutions Posner has the 2 poles to referee between Split up -DOJ and Dismissal - MSFT.8. Now that it is all laid out on paper before the referee things will start moving along. 9. All this should be viewed as a plus for MSFT as the DOJ has probably looked pretty stupid before the referee so far.10. This 4 point drop should have been seen as a great buying opportunity this AM.

This whole thing is a joke and I can't see Posner really being able to convince DOJ that there is no case and that the consumer has not been harmed and not even the corporate competitors who claimed injury and initited this suit through the DOJ can show any harm whatsoever. It therefore will go to Appeals Court where MSFT will win.

Perhaps the fact that because of DOJ's decision to seek the worst insures that this will not be a negotiated deal and signals to the market that it will take a little while longer. And therefore the market which abhors uncertainty dumped MSFT. However the reality is that this is a grand buying opportunity. JFD
