Myself I think it is a small stock downdraft, bio being out of favor at the moment and the sale of the aforementioned big 120,000+ share block of GSII which caused it to fall as much as it did. If someone thinks that this ruling has any effect on GSII, they have a very vivid imagination. One could understand where an IV imaging agent for Ultrasound could be made out to be a drug and not a device. The fact that the imaging agent is not metabolized, and is essentially inert in the body, technically makes it a med device. The problem is the FDA is treating some of the other companies imaging agents as drugs, so they are asking the court to have them all treated consistently. From the standpoint of another biotech/med having problems, it is another nail in the coffin of the whole sector, along with some of the other recent negative bionews. However, I think the whole sector is depressed regardless of this announcement. In reality, the small caps didn't participate in Tuesdays rally, and the Dow and S&P didn't participate in Wednesdays small cap rally. The markets seem to be moving in sectors of late, not cross the board.
