Back in mid July the US appeals court ruled that Qcom should have received the discounted spectrum license from their 1992 application. In July 1999, the FCC was ordered "to take prompt action to identify a suitable spectrum and award Qualcomm the license for it."

I don't remember seeing any further info on this. Anyone know the current status and what a likely outcome might be? If they were to get spectrum in a decent market, would it make sense to use it to trial 1xRTT and HDR?

Part of the problem in determining a "fix" was the fact that all of the available licenses were gone. If the FCC takes back the Nextwave licenses, suitable spectrum becomes available?
