I doubt it.

From what I've read at Dillon Read, the PTO is very likely to give VISX an amended patent which supercedes the '388, and will give VISX the same intellectual property monopoly as it had before.

If VISX was in trouble, then why did Lasik Vision decide to make 100-laser purchase deal with VISX? Because VISX's patent position is sound and Nidek will likely lose in CA civil court with the patent ammo VISX could not use during the ITC proceeding. Plus, all users of Nidek lasers will be sued and will likely lose, either by owing treble damages, or costly litigation in defense of themselves.

I think Raging Bull is buying into the ill-informed conventional wisdom which has contributed to VISX tanking recently.
