This whole suit really is absurd. I saw a video featuring a mock-up of a clamshell PCS phone and held the mock-up in my hands over two years ago. It was put together by a partner in a current CDMA PCS joint venture. Surely Qualcomm is aware of that and can use it to bolster their case that batwing's design is hardly original. My experience pre-dates batwing's introduction of the StarTac by a year, and I know the video had been around for probably at least six months prior to my viewing.

Can Q countersue BW for damages caused by a baseless suit? Geez, where is Chris's vitriol when you need it?
