Digger,
Allow me to clarify my position. I stated:

As I have stated earlier, contract law has precedence over other statutes. From that perspective, it appears certain that Aber will loose.

I expect Aber's suit will likely be thrown out of court (Would you interpret that as a speedy and decisive outcome?). Should that happen, I suppose there is nothing to prevent Aber from filing another suit on diferent grounds.
