Then it sounds as if BW has consciously undertaken a business strategy based on litigation, albeit at the cost of alienating a sometimes supplier and many customers. They are buying time for their entry into the CDMA handset marketplace but probably hurting the market penetration of CDMA systems operators for lack of an additional attractive, available product to sell. If I were PrimeCo or Sprint, I'd be pissed at Moto for this suit and let them know it. I wonder if they've considered the long term damage to their customer relationships. If I had been prevented from purchasing available product in this manner by a supplier's competitor who subsequently wants my business, I can tell you what my predilection would be. Even with better pricing and/or functionality, I wouldn't want to reward a company that had abused its market power or the legal system to my detriment, lest they be encouraged to do so again. I wonder if BW has thought all that through? Same goes for Ericsson, who supplies the major operators' systems based on other technologies.
