I seem to remember an NR saying that Winspear offered $40 or $50 million to Aber, to buy them out of Snap. If so, they do have a buyer. Perhaps Aber has been waiting to see what Snap has, and delaying the acceptance of that offer using the court case as a reason, until RT and the gang do enough work to make it obvious whether it is prudent to accept or reject the offer.

Perhaps this is why we hear RT only talking of 1000 tonne per day processing rates working up to 3000 in several years. If he talked about the real rates of 6000 tpd working up to 10000 tpd Aber wouldn't sell so cheap.
