No, I don't think PCModem is confused. Troubled maybe, but not confused [wink]. I think he fully comprehends the seriousness of John A. Schmitz' NASD discipline. The comment that surprises me is his notion that the victim should sue the NASD for not prosecuting Schmitz. I'm not sure that such a cause of action exists.... The NASD is a private association which enforces its rules through disciplinary proceedings. To make such a statement indicates to me that he feels quite strongly about misconduct of this nature, as I am sure most of us do. However, as he goes on to point out, without all of the facts it is not possible to understand the full extent of what transpired outside of the limited context of the statement in the NASD document. We can only speculate. I believe the NASD disciplinary action, i.e. the document, speaks for itself as to the events charged. A fine, debarrment and restitution ordered by one's professional licensing organization carry with them a tremendous stigma.
