U.S. Ruling on Qualcomm Patents Could Benefit Local Firms

The legal battle between American telecommunications equipment giants Qualcomm and Motorola over CDMA cell phone patents in Korea is heating up. The Korean Industrial Properties Office (KIPO), which issues Korean patents, said Wednesday that as a U.S. court has recently ruled in favor of Motorola in a lawsuit it filed against Qualcomm­îs registering of patents for CDMA technology in Korea, a number of the latter firm­îs local patents have been cancelled. KIPO added that further cancellation of other patents held by Qualcomm is possible depending on additional rulings in the case.

Local telecommunications firms that have been making huge royalty payments to Qualcomm now expect to be able to renegotiate royalty agreements with the American company as a result of the case. KIPO said that up to the first half of last year, local firms such as Samsung Electronics, LG Information and Communications, Hyundai Electronics and Maxon Electronics had paid out a total of US$376 million to Qualcomm for royalties. KIPO expects that the legal war between Qualcomm and Motorola will continue to intensify as the dispute also includes other non-cell phone technologies derived from CDMA technology.
