New taxes may not pose an immediate threat to the rapid growth of Internet
retailing, but old taxes certainly do. The 46 states with retail sales taxes are
dusting off a little-known levy called the "use tax," created decades ago in
response to catalogue sales, and recasting it as a tax on retail sales online. If they
can overcome the obstacles to collecting the tax, which is exacted on residents'
out-of-state sales, a perceived advantage enjoyed by Internet merchants could
dwindle.

Internet merchants aren't thrilled by the prospect of sales taxes, but they would
tolerate them. Their big fear is that the states will concoct a tax-collection regime
that is so inefficient and complex that it not only would sour online shoppers, but
would also tie up merchants with red tape and otherwise reduce the cost edge they
enjoy over old-style bricks-and-mortar merchants."
