Norman, the question will be whether "prior art" (not belonging to RMBS, or in the "public domain") already disclosed what was later (1999) patented, then the date of the first disclosure to the patent office (or even internal documents at RMBS proving earlier "reduction to practice of the IP), will determine if what Hitachi did was in the "prior art" and not protected by RMBS, but the royalties will start at best, from the first disclosure to Hitachi by RMBS of the technology.
