I was thinking about your comment this morning that anyone buying now is gambling.

I will assume you mean that anyone buying before earnings is gambling but I'd say KK already tipped his hand.

If I was completing a $15 billion dollar merger and wanted to make sure it would be approved by the shareholders of both companies, I'd:

1). Wait until AFTER the company being acquired announces their earnings. (No TLAB/CIEN repeat). Make sure the company you are buying actually reports the type of growth you negotiated against. If I recall correctly, the ETEK merger announcement came a few days AFTER ETEK announced their earnings.

2.) Make sure your own earnings will come in as expected. The surest way to kill a deal is to have your currency (stock in this case) fall because you couldn't make your number. I'd also guess that JDSU knew enough about their earnings at the time of the ETEK announcement to be certain that their stock wouldn't take a substantial hit after the official announcement.

So I also used yesterday's pullback to add some more shares of JDSU and I certainly don't think I took any sort of gamble.
