I think there is a difference between shorting and selling.
I can sell a stock because I need the money, or because I want to invest in something else. I may even sell to protect my gains against possible downturn.
But to "borrow" shares and sell them with the explicit intent to profit from a drop (and possibly leading to a drop due to a selling pressure) seems to me to be against the fundamentals of the equity markets. This is not supposed to be a casino for people to place their bets. We are supposed to invest in or trade equities with progress in mind.

If you open a store for business, is it legal or ethical to spread rumors about your competitors or vandalize their properties so that you can profit? If you think a company is over-bought, don't buy it, move on to something that suits your taste. Shorting equities just doesn't make sense (I understand that it can be profitable, but there are lots of profitable activities that are not legal or ethical.)
