Yes. Two days ago.

The U.S. court of appeals for the second circuit has made it quite clear (for those who have read their opinion) that the sole responsibility for the allocation of licenses lies with the FCC, with appeals to the court of appeals, not the bankruptcy or district courts.

This is a regulatory issue, not a creditor issue. Judge Hardin has no say in the matter.
