J Although no ardent supporter of MOT...I do believe that the press release is "couched" in belief. Note the sentence in the press release immediately prior to the offending sentence you cite. Nevertheless, must have been a tough night for MOT's litigators...and regardless of their "undiminished pursuit", although not fatal, this ruling must generate some review of whether the likely millions of dollars in legal fees to be spent getting this issue to trial will be well spent.
