Unusual? I really can't consider the answer to that question because I don't know the deal universe. Some of the deals I've heard about use them. QWST and USW used them.

But I guess that it's up to each buyer and seller to negotiate this. Maybe ETEK did, but I just don't know. If I owed a public company and were to be acquired, I would try to make it part of my deal.

In fact.....when my wife acquired me, I made it mandatory! <VBG>
