Biowa, I just finished reading the patent and it looks damm broad, on its face clearly covering Zev. You can bet the patent lawyers at IDEC are burning the candles looking for an attack. The key question in the US is time of discovery which we can not know for certain. Hopefully the CLTR people have good lab notes. However, I caution that we do not know what applications if any that IDPH has filed or how far back they can document their work in this area. It strikes me the most likely scenerio is a licence agreement with IDPH and CLTR resulting in both some nice downside protection if CLTR keeps having its BLA problems. The upside of course is a double digit royalty on Y2B8. V1
