This is off the top of my head after only two cups of coffee, but the standard for a preliminary injunction is two-fold: the person seeking the injunction must satisfy the court that there is an imminent risk of harm which only an injunction can prevent, and that there is a likelihood of prevailing in the litigation.

This is just a preliminary injunction, the defendant can come rushing into court and ask for a short hearing and present his own facts which contradict the facts presented by the plaintiff. Neither one of them has to wait for a full blown trial.

Injunctions are equitable in nature, they are intended to prevent harm.
