No, I repeated what the headline was on ROB-TV. Second, an appeal was obvious, noone in the US judicial system accepts what a jury says first time out.

the lawsuit is not over and even if wht doesnt win they
still retain the patents so it has very little impact


The lawsuit decision is that ABMD has not impinged on the patent.

Let me quote from the jury decision (from National Post)

"In the end, jurors concluded that Abiomed didn't misappropriate World Heart's proprietary information because the information didn't amount to a trade secret"

So WHT can have their patent on TET, if they lose the appeal then ABMD will be operating a "like" TET but with no patent infringement. If it is allowed to stand, then ABMD could mass produce their device selling it to anyone they want.....reread the ruling.

I knew I would have to explain this to you....Listen carefully. Lets use a small figure so I don't lose you.

If a person has 100 shares long and then shorts 100 shares at 15 1/2 what is the net result of a stock falling to $10.00...the net result is that you gain $5 1/2 from your short shares but lose $5 1/2 on your long shares....so the net net is you have lost NO money on the drop...in fact you have tied your long shars to the 15 1/2 price. So Have I benefited by driving the price down, as you insist? No!

If I am wrong and the stock goes up to 20 1/2 I lose $5.00 on my short shares but have gained $5.00 on my long shares....net net $0....I am just "locking in my long shares at 15 1/2 either way.

I appreciate your stalwart position on GLE, I have listened to your natterings from $7.00 all the way to $31.00....it will hit 35.00 two days before TSE 300 listing...so roughly $16th Feb....we'll see!! I don't care if it was riding NT coattails its a winner and you missed it!
