MP3.com, RIAA square off with suit
Countersuit cites alleged 'bullying'

SAN DIEGO (CBS.MW) -- MP3.com filed suit against the Recording
Industry Association of America for alleged unfair business practices, less
than three weeks after the same trade organization charged the online
music specialist with copyright violations.

MP3.com Chief Executive Michael Robertson said in a statement that the
RIAA was engaged in "bullying tactics."

On Feb. 21, the San Diego-based company was sued by the RIAA in a
move that could shape the fate of billions of dollars in music royalties.

The controversy is swirling around a new service by MP3.com to offer
digital copies of CDs purchased by consumers.

"Simply put, it is not legal to compile a vast database of our members'
sound recordings with no permission and no license," Rosen said in an
open letter to MP3.com last month. "And whatever the individual?s right
to use their own music, you cannot exploit that for your company?s
commercial gain."

Shares of MP3.com closed unchanged at 28 1/2 Tuesday.

The RIAA couldn't be reached for comment.
