I just ran across an old press release that some of you may enjoy reading - 6-20-95-"QUIDEL IS ISSUED PATENT FOR ONE-STEP SAMPLE PREPARATION AND DETECTION RAPID DIAGNOSTIC TESTS"- This release says Qdel announced "the United States Patent and Trademark Office has issued patent number 5,415,994 which broadly covers devices, methods and kits as they relate to the simultaneous processing and detecting of biological swab specimens in a diagnostic test"
"The company's new patent covers the innovative "in-line" swab sample treatment method pioneered by the company and found in its recently introduced QuickVue In-Line One-Step Strep A Test. This is the rapid testing industry's first product to incorporate swab sample processing and lateral flow detection into a single step."
This sure doesn't sound like any "intentional" infringement to me especially w/ the words "New", "first" and "innovative". Quidel's Answer to the BD lawsuit is due to be filed w/ the Court this week. Hopefully, we will be able to get a better idea of Qdel's position then.
